#5 In A Series: What's a Real Property Report?

The Real Estate Purchase Contract Section 4.11 states that "At least ten (10) business days prior to the Completion Day, the Seller will provide the Buyer ... a real property report reflecting the current state of improvement on the property, according to the Alberta Land Surveyor's Manual of Standard Practice, with evidence of municipal compliance or non-conformance.

What on earth does that mean?

This very significant paragraph means that the Seller must supply the Buyer with a report showing that the property's improvements, i.e., the driveway, deck, sidewalk, garage, and the main buildings are all completely within the property lines of the real estate being considered. Not only must this document show the buildings, their dimensions, any fences, sidewalks or other improvements, but may also show electrical lines, utility rights of way alley entrances, or any other feature, mainly man-made that may have effect on the placement of future buildings. For instance, the location of gas lines to the home can have a significant effect on the placement of garages, driveways or fences.

The Real Property Report, often referred to by its initials RPR gives buyers confidence that the land and buildings they are about to purchase exist and are of a certain size and shape. Perhaps more importantly, the document proves that the improvements on the land are wholly within the boundaries of the land and do not extend into neighbouring properties, thus avoiding difficulties with neighbours. RPRs are required to be newer than five years old, although older ones may be accepted if no changes have taken place.

The cost of having a Real Property Report created by a Surveyor us usually between $250 - $400. This cost is the responsibility of the Seller.
